Enforcement

The Building Services Department is responsible for enforcement of the Building Code Act, Ontario Building Code and some municipal by-laws within the jurisdictional boundaries of the Township of Norwich.

The Building Code Act identifies:

A person is guilty of an offence if the person,

    1. knowingly furnishes false information in any application under this Act, in any certificate required to be issued or in any statement or return required to be furnished under this Act or the regulations;
    2. fails to comply with an order, direction or other requirement made under this Act;
    3. contravenes this Act, the regulations or a by-law passed under section 7 (municipal Building By-law).

The Building Services Department accepts notifications from the public and external agencies of potential contraventions to the Building Code Act, Ontario Building Code and municipal by-laws. Additionally, Building Inspectors may conduct proactive investigations for conformance.

Upon becoming aware of a potential contravention, a building inspector will conduct an investigation of the alleged contravention to determine whether enforcement action is necessary. Investigations may include support from other departments or agencies as needed.

Examples:

    • Construction or demolition without a permit
    • Changing the use of a building to one of a greater hazard without a permit
    • Unsafe building
    • Failing to maintain a sewage system
