Building & Demolition Permits

building permit is an official approval issued by the municipality that allows construction, alteration, addition, or renovation of a building to proceed in compliance with the Ontario Building Code, local zoning by-laws, and other applicable regulations.

A demolition permit is required before removing all or part of a building or structure to ensure that the demolition work is carried out safely and does not adversely affect neighbouring properties or public infrastructure.

Purpose
Building and demolition permits are required to protect public health, safety, and welfare. They ensure that construction and demolition activities meet established standards for structural integrity, fire protection, energy efficiency, and accessibility. Obtaining a permit provides a formal review and inspection process that helps safeguard property owners, future occupants, and the community as a whole.

A building permit must be obtained prior to starting construction on any building over ten square meters (108 square feet) in area and that does not contain plumbing.

Also,

A building permit must be obtained prior to starting construction on any building that contains plumbing regardless of the buildings size.

A building referenced above means any structure that consists of a wall, a roof, and/or a floor.

Construction includes erecting a building, installing a building, extension (addition) of a building, altering the materials used in the construction of a building or repairing a building.

A building permit is required for construction whether the work is on the interior or the exterior of the building or dwelling. There is no exemption for a building permit when performing construction solely within or inside a dwelling.

Additionally, the Building Code Act and Ontario Building Code also list specific types of structures and components that are also considered a building and thereby require a building permit to be obtained prior to construction.

A demolition permit must be obtained prior to starting demolition on any building that contains plumbing regardless of the buildings size.

Demolition consists of removing a building or any material part of a building.

A demolition permit is required whether the work is on the interior or the exterior of the building.

Examples of projects that require a demolition permit

    • Demolishing any building, other than a farm building, greater than 10m2 (108 ft2) in size
    • Demolishing interior or exterior walls, floors, roof, or ceiling whether loadbearing or non-loadbearing

Note: Buildings used for the sole purpose of farming do not require a demolition permit to demolish. This exemption does not apply to dwelling units on a farm or any buildings located on a farm that are not solely used as a farm building.

Before you start a new project, check the zoning of your property to determine the permitted uses and the required standards applicable to the property.

You may locate the property using GLIMR, an interactive mapping tool provided by Oxford County, to determine the zoning designation.

Once the zoning designation of a property has been identified. Discover the applicable standards for the zone using the Township of Norwich Zoning By-law.

Depending on the type of project you are working on and where your property is located, you may need other approvals before your building or demolition permit can be issued.

Various forms, drawings, and other documents are required to be submitted as part of a complete permit application. The required information is used to determine whether the proposed construction or demolition will conform with the Building Code Act.

Ensuring that the required information is submitted with the permit application and detailed enough to determine conformance with the Building Code Act can help reduce processing delays.

In most cases, a design professional such as an architect, professional engineer, or a qualified designer registered with the Ministry of Municipal Affairs and Housing is required to create complete and accurate drawings that comply with the building code and applicable law. These drawings will need to be submitted along with your permit application.

The Township of Norwich does not specifically endorse any individual designer or organization. This list has been assembled for general information purposes only.

The following types of projects are exempt from requiring a design professional to complete the drawings:

    • A house or an ancillary building that serves the house and that are designed by the owner
    • An ancillary building that serves a house and is not more than 55 square meters in area
    • A farm building that is less than 600 square meters in area, 2 storeys or less in height, and is of low human
    • A sewage system designed and to be constructed by the owner
    • Unenclosed tents or groups of unenclosed tents that do not exceed 225 square meters in area and do not contain bleachers
    • Construction of site services including surface drainage and plumbing located underground, either outside a building or under a building
    • Construction of appliances, equipment and similar incidental components of a building

All drawings prepared by a holder of a licence under the Architects Act or the Professional Engineers Act of Ontario must be signed, sealed, and dated by the licensed person.

Drawings that are prepared by a qualified designer must include:

    • The qualified designer’s name
    • The qualified designer’s registration number
    • The qualification identification number of the qualified designer (Building Code Identification Number: BCIN)
    • The qualified designer's signature
    • The stamp or statement that the qualified designer has reviewed and taken responsibility for the design activities

Submission requirements for a building or demolition permit include:

    1. A completed Application for a Permit to Construct or Demolish
    2. A completed Schedule 1 form (not required for drawings prepared by licence holder from the OAA or PEO)
    3. A completed Schedule 2 form (only required for on-site sewage systems)
    4. All required drawings and documents to confirm conformance with the Ontario Building Code
    5. Owner authorization letter (if the applicant is not the owner)
    6. Application fee (see Fees)
    7. A Commitment to General Review form completed by licensed Architect(s) and/or Professional Engineer(s) as required.

Review Process

Your application will be reviewed to confirm that your project will comply with the Ontario Building Code and applicable approvals required. The review process includes:

    1. Complete Application Review: Staff will check that all minimum submission requirements are met and that the proposed project conforms with the Zoning By-Law and applicable laws. If an application does not comply with these requirements, the application is considered to be incomplete and the applicant will be notified, in writing, of the reasons why the application is considered incomplete.

      This review should be completed within two business days beginning on the day after the application is submitted.

    2. Building Code Review: Complete applications will proceed to this stage, where staff review the proposed construction for compliance with the Ontario Building Code. If the submitted drawings or documents do not demonstrate compliance, or if additional information is required to confirm compliance, the applicant will be notified in writing of all items that must be addressed.

      The timeline for this review varies based upon the type of building, complexity of the project and quality of the design submission.

Definitions for uses listed above:

Assembly occupancy means the occupancy or the use of a building or part thereof by a gathering of persons for civic, political, travel, religious, social, educational, recreational or like purposes, or for the consumption of food or drink. 

Business and personal services occupancy means the occupancy or use of a building or part thereof for the transaction of business or the provision of professional or personal services.

Care occupancy means an occupancy, other than a retirement home, in which special care is provided by a facility, directly through its staff or indirectly through another provider, to residents of the facility

  1. who require special care because of cognitive or physical limitations, and
  2. who, as a result of those limitations, would be incapable of evacuating the occupancy, if necessary, without the assistance of another person.

Care and treatment occupancy means and occupancy used for care (as described above) and the provision of medical or other health-related intervention to persons, where the administration or lack of administration of these interventions may render them incapable of evacuating to a safe location without the assistance of another person.

Demountable stage means a structure that

  • consists of one or more platforms together with any wall, roof or other structures attached to or located on any of the platforms,
  • is intended to be used for public or private performances or events, other than performances or events associated with movie or television productions,
  • is intended to be erected, assembled or installed for a limited specified time,
  • is capable of being dismantled at its location and moved to be reconstituted elsewhere or is erected for one-time use,
  • is not located inside a fully enclosed building ,
  • is primarily for use by performers and workers, and
  • may or may not be mounted on wheels.

Demountable support structure means any structure that

  • is capable of supporting banners, stage sets, props, sound equipment, lighting equipment or other equipment,
  • is intended to be used for public or private performances or events, other than performances or events associated with movie or television productions,
  • is intended to be erected, assembled or installed for a limited specified time,
  • is capable of being dismantled at its location and moved to be reconstituted elsewhere or is erected for one-time use,
  • is not attached to or located on a demountable stage ,
  • is not located inside a fully enclosed building ,
  • is primarily for use by performers and workers, and
  • may or may not be mounted on wheels.

Detention occupancy means the occupancy by persons who are restrained from or are incapable of evacuating to a safe location without the assistance of another person because of security measures not under their control.

High-hazard industrial occupancy means an industrial occupancy containing sufficient quantities of highly combustible and flammable or explosive materials which, because of their inherent characteristics, constitute a special fire hazard.

Low-hazard industrial occupancy means an industrial occupancy in which the combustible content is not more than 50 kg/m2 or 1 200 MJ/m2 of floor area.

Medium-hazard industrial occupancy means an industrial occupancy in which the combustible content is more than 50 kg/m2 or 1 200 MJ/m2 of floor area and not classified as a high-hazard industrial occupancy.

Mercantile occupancy means the occupancy or use of a building or part thereof for the displaying or selling of retail goods, wares or merchandise.

When an application passes all reviews, the applicant shall be notified of all remaining fees and charges owing prior to issuance of the permit.

The permit is issued upon the payment of all outstanding fees and charges and will be available online for applications that were submitted online. If an application was submitted in person, staff will contact the applicant to notify them once the permit is available to be picked up at the office.

Only upon the issuance of the permit, are you legally permitted to commence construction or demolition.

You must ensure that the permit is posted at the construction site and that the approved drawings are made available at the construction site for the Building Inspector to undertake the mandated inspections.

If you have been issued a building permit but need to change the scope of work resulting in a material change to a plan, specification, document or other information on the basis of which the permit was issued you’ll need approval from the Building Services Department.

Approvals can be in the form of a “field revision” approved by the chief building official or building inspector in the field or a formal revised permit.

An inspector may feel comfortable with approving a revision in the field where the change is considered minor in nature (e.g. adding a closet, slightly changing interior wall locations, changing a bathroom layout in a house). Changes that have a material affect on the design, use, structure or service systems will require a formal application to be submitted for review of the proposed revision(s).

Revision applications may be submitted via the Citywide Portal or in person.

Submission requirements for a request to revise a permit:

    1. A written notice describing the nature and location of the proposed change(s)
    2. A completed Schedule 1 form (not required for drawings prepared by licence holder from the OAA or PEO)
    3. A completed Schedule 2 form (only required for on-site sewage systems)
    4. Drawings and/or specifications that accurately identify the proposed change(s)
    5. Application fee (see Fees)

The Chief Building Official may revoke a permit where:

    • It was issued on mistaken, false or incorrect information,
    • If, after six months after its issuance, the construction or demolition has not been seriously commenced,
    • If the construction or demolition is substantially suspended or discontinued for more than one year,
    • If it was issued in error,
    • If the permit holder requests in writing that it be revoked, or
    • If a term of a conditional permit has not been complied with.

If you no longer wish to proceed with a project for which a permit was issued, please submit a written request to the building services department requesting the permit be revoked.

A conditional permit is a type of building permit that may be issued when some required approvals are still pending. Conditional permits are typically used for larger development projects.

There are some applicable laws that must be complied with prior to the Chief Building Official considering an application for a conditional permit. These laws are:

    • Compliance with the Zoning By-law
    • Compliance with an Interim Control By-law (where applicable)
    • A permit is issued by the Ministry of Transportation for work proposed within 30m of a transit corridor
    •  A permit has been issued by the applicable Conservation Authority (where required)
    • Approval is obtained from the Ministry of Environment, Conservation and Parks for a Part II.3 project designated under the Environmental Assessment Act
    • Required approvals under the Ontario Heritage Act have been obtained
    • Confirmation of the following facts is received from the Condominium Authority of Ontario for residential condominium conversions projects:
      • the fact that the residential condominium conversion project, the units or proposed units of it and the common elements of it have qualified for enrolment in the Plan or have been enrolled in the Plan, as the case may be;
      • the fact that the builder of the project holds a licence as a builder under the New Home Construction Licensing Act, 2017 in respect of the project; and,
      • the fact that the vendor of the project holds a licence as a vendor under the New Home Construction Licensing Act, 2017 in respect of the project.

A conditional permit does not fast-track a project and does not bypass the technical reviews needed to ensure public health and safety.

Requesting a conditional building permit

Submit a written request to the Building Services Department including:

    • application fee, and
    • supporting documentation showing compliance with the applicable laws noted above

A Conditional permit may be issued at the discretion of the Chief Building Official (CBO) when the applicant demonstrates that outstanding applicable law approvals are actively being pursued and that the associated timelines are causing unreasonable construction delays.

When considering the issuance of a conditional permit, the Chief Building Official will require the property owner to enter into a legal binding agreement with the municipality in which the owner agrees to:

    1. assume all risk in commencing the construction,
    2. obtain all necessary approvals in the time set out in the agreement or, if none, as soon as practicable,
    3. file plans and specifications of the complete building in the time set out in the agreement,
    4. at the applicant’s own expense, remove the building and restore the site in the manner specified in the agreement if approvals are not obtained or plans filed in the time set out in the agreement, and
    5. comply with such other conditions as the chief building official considers necessary, including the provision of security for compliance with subclause (iv).

Fee and charges are calculated at two stages based on the relevant by-laws.

At the time of submitting an application, a portion of the application fee is due, this is referred to as the base fee and is calculated based on the Township of Norwich Building By-law. The base fee is intended to cover the initial costs associated with reviewing the application.

Once the review of an application is completed, the remaining fees and charges are calculated, and the applicant is notified prior to issuance of the permit.

The Township of Norwich imposes a development charge upon the development of any land within the municipality to assist with the costs of growth-related capital projects. Development charges play an important part in how growth-related infrastructure is financed. Each new or expanded residential and non-residential development requires increased municipal infrastructure and services to function efficiently and effectively.

Municipal Infrastructure Damage Deposit

$1,200.00 where a sidewalk is in place and/or work is being done within the right of way

Permits issued within an urban and village area require payment of a damage deposit prior to issuance of the permit. Damage deposits are collected to support repairs where damage has occurred to municipal infrastructure as a result of the proposed construction or demolition.

Damage Deposits will be returned upon verification by the Township Roads Superintendent or designate, subsequent to the completion of any work done on entrance culverts, curbs, gutters, or ditches that is deemed necessary and performed by the Corporation, less any amount that is expended by the municipality to make repairs or for cleanup.

Where work has been done within the municipal lands, roads, etc., the 
deposit will be held for the period of one calendar year, after which the 
deposit becomes subject to the provisions below for extensions.  Notwithstanding such an extension granted by the Township Roads 
Superintendent, a remaining balance of the deposit will become forfeit to the Corporation. 

Lot Grading and Drainage Deposit

$750.00 when a lot grading and drainage plan is required.

A lot grading and drainage deposit shall be paid prior to issuance of a permit.

Use of the deposit may be deemed necessary when, in the opinion of the Chief Building Official;

  • The lot grading (including topsoil) has not been completed in 
    accordance with the approved grading and drainage 
    plan and where the Chief Building Official receives confirmation of such non-conformance by the engineer of record, or
  • Grass sodding has not been placed, or there is no established growth from seeding over the distribution area of a septic system within one year from the last date of inspection, or completion of construction of the system, whichever is the lesser.

The deposit may be used when the depositor does not complete the grading and drainage work in compliance with the grading and drainage plan, as approved in accordance with the issuance of a building permit.

In such a case, the deposit shall be used in balance against the cost of any work to grade, drain, seed or sod the lot as necessary to conform to the approved plan, and the requirements of building code.

This deposit less any portion expended by the municipality to obtain 
compliance will be refunded upon receipt of verification of compliance with the plan from the Professional Engineer or Ontario Land Surveyor who developed the plan.

The balance of the deposit remaining, if any, is refundable, without interest, when the construction is substantially completed and a final inspection of the construction has been completed in accordance with the building code requirements, and all entrance culverts approved by the Township Roads Superintendent. 

Building Construction and Inspection Deposit

The building construction and inspection deposit is secured to ensure that all construction or demolition work commenced under a building or demolition permit is completed, inspected, and finalized in conformance with the provisions of this by-law, the building code, and the act. 

All deposits are to be held to secure compliance with the provisions of the building code which describe the prescribed inspections, notice of intent to occupy, conditions to the issuance of an occupancy permit, and requirement to request final inspections. 

This deposit, less any portion expended by the municipality in enforcement of compliance, will be refunded without interest upon:

  • issuance of an occupancy or use permit for the building under permit where applicable; and 
  • confirmation of completion of a final inspection by a building 
    inspector, noting that construction has been fully completed in 
    compliance with the act, the building code, and in accordance with 
    the application documentation.

In the event that a building permit is revoked in accordance with subsection 8.(10) of the Building Code Act, or where construction or demolition occurs in contravention of subsection 8.(13) of the Building Code Act, the deposit shall be forfeited to the Corporation. The balance of the deposit shall be retained by the Corporation and dispensed to the Building Department Cost Stabilization Reserve Fund. 

The Township is mandated by the Ontario Building Code to provide building inspections associated with construction authorized by a permit.

Purpose
Building inspections are conducted to ensure that all construction complies with the Ontario Building Code, applicable laws, and any approved plans or permits. Their primary purposes are:

    1. Protect Public Health and Safety
    2. Verify Compliance with the Ontario Building Code

It is the responsibility of the permit holder to arrange inspections at key stages of construction.

The building inspector will need to inspect your project at several stages during construction and demolition. The following stages of a project require an inspection prior to covering the work. 

Some stages may not be applicable to your particular project.

Permit holders will receive a list of required inspection stages along with their permit.

Note: The building permit is required to be posted in a visible location at all times.

Inspection Stage Description
Footing

Completion of excavations, site preparation and installation of formwork.

Required prior to placement of concrete.

A geotechnical soils report confirming soil-bearing capacity may be requested by the inspector if warranted by on-site soil conditions

Backfill

Substantial completion of footings and foundations including below grade dampproofing, waterproofing, and foundation drainage.

Required prior to commencement of backfilling.

Plumbing underground

Completion of all underground plumbing and the readiness for testing. (includes building sewers, building drains, water service piping, fire service mains and venting systems)

Plumbing rough-in above ground

Completion of all plumbing above ground and the readiness for testing. (includes water distribution systems, drainage systems, venting systems, fire service mains, and any plumbing fixtures and appliances that may be covered)

Framing & HVAC rough-in

Substantial completion of all structural framing, heating and air-conditioning distribution system, and air-contaminant extraction equipment (where applicable)

Air barrier systems

Substantial completion of the air barrier system

Insulation and vapour barriers

Substantial completion of the insulation and vapour barriers.

Plumbing final

When plumbing system, fixtures and appliances are completed (test required)

Fire separations and closures

Substantial completion of fire separations and closures

Standpipe system

Substantial completion of a standpipe system

Sprinkler suppression system

Substantial completion of sprinkler suppression system throughout the building

Public pool suction and gravity system

Completion of suction and gravity outlets, covers and suction piping serving outlets of a public pool

Public pool/spa circulation/recirculation system

Completion of circulation/recirculation system of a public pool or public spa

Public pool/spa final

Substantial completion of the pool/spa before it is filled with water

On-site sewage system (septic system) excavation

Completion of all excavation and site preparation prior to construction of the sewage system

If you are unsure when to request an inspection, staff can review the required inspection schedule with you at any time, either before or after the permit is issued.

You or your contractor are responsible for scheduling inspections at the appropriate stages noted above. Inspection dates and times are subject to inspector availability. When the preferred inspection date is unavailable, the Township will make every effort to schedule the inspection within the following timeframes:

If you need to cancel a scheduled inspection, contact the building services department as soon as possible.

  • Login to the Citywide Portal and select go to project under the project requiring and inspection.
  • Select the application by clicking on the address. A page will pop up with the details of your project location.
  • At the bottom of the page there will be a heading work & construction and a box entitled
  • Click on show upcoming inspections and select request inspection
  • Under the new inspection request box that pops up, select the date and time you would like to request
  • Your request will be listed. Staff will send a confirmation email once your request is received
  • You can change the date, time or cancel your request by selecting modify request

Additional Inspection Requests

Permit fees paid prior to issuance of the permit include inspection of the project at the applicable inspection stages listed above.

If a project does not pass a required inspection, you will be responsible for correcting all deficiencies that prevented the inspection from passing.  You or your contractor are responsible for scheduling a re-inspection once all deficiencies have been corrected. There will not be any additional charges for one re-inspection per inspection stage.

Additional charges may be applied where an inspector arrives on-site for a scheduled inspection, and the work has not been completed or previously identified deficiencies remain outstanding.

Make sure you meet these requirements to ensure the inspection can be completed:

    • Post the permit in a visible place at the project site
    • Make sure you carefully reviewed the approved permit documents and drawings provided by the Township
    • Keep all printed permit documents and drawings on site (copies should be printed in colour on paper no smaller than 11×17 inches)
    • Make sure all areas of inspection are clearly visible and accessible for the inspector
    • Make sure proper access is available to the area being inspected
    • Make sure all applicable health and safety requirements are in place on the construction site

A person shall not occupy or use a building or part of a building that is newly erected or installed until such time as occupancy has been approved by the chief building official or an inspector.

Upon passing a final inspection for a new building or an addition to an existing building, the building inspector shall issue an occupancy permit thereby approving the occupancy of the building or portion of the building to which the occupancy permit relates.

Where a building has not been fully completed, the chief building official or an inspector will still issue an occupancy permit provided that specific building components and systems are complete in conformance with the Ontario Building Code.

The specific building components and systems required for occupancy vary by building type and are provided below.

This section applies to a residential building that,

    • is of three or fewer storeys in building height and has a building area not exceeding 600 m2,
    • has no accommodation for tourists,
    • does not have a dwelling unit above another dwelling unit,
    • does not have any dwelling units sharing a common means of egress, and
    • does not contain a retirement home.

Occupancy Requirements

An occupancy permit shall be issued provided that there are not any outstanding orders, development charges are paid, and the following building components and systems are complete, operational and inspected:

    1. the structure of the building with respect to the dwelling unit to be occupied is substantially complete and ready to be used for its intended purpose,
    2. the building envelope, including, but not limited to, cladding, roofing, windows, doors, assemblies requiring fire-resistance ratings, closures, insulation, vapour barriers and air barriers, with respect to the dwelling unit to be occupied, is substantially complete,
    3. the walls enclosing the dwelling unit to be occupied are complete,
    4. required electrical supply is provided for the dwelling unit to be occupied,
    5. required firefighting access routes to the building have been provided and are accessible,
    6. the following building components and systems are complete and operational for the dwelling unit to be occupied:
    7. required exits, floor access and egress systems, handrails, guards, smoke alarms, carbon monoxide alarms and fire separations, including, but not limited to, fire stops,
    8. required exhaust fume barriers and self-closing devices on doors between an attached or built-in garage and the dwelling unit,
    9. water supply, sewage disposal, lighting and heating systems,
    10. protection of foamed plastics,
    11. water system,
    12. building drain and building sewer,
    13. drainage system and venting system,
    14. required plumbing fixtures in the dwelling unit to be occupied are substantially complete and operational, and
    15. radon control requirements

This section applies to a residential building that,

    • is of three or fewer storeys in building height and has a building area not exceeding 600 m2,
    • has not more than 1 dwelling unit above another dwelling unit,
    • has not more than 2 dwelling units sharing a common means of egress,
    • has no accommodation for tourists, and
    • is not used for a retirement home.

Occupancy Requirements

An occupancy permit shall be issued provided that there are not any outstanding orders and the following building components and systems are complete, operational and inspected:

    1. required exits, handrails and guards, fire alarm and detection systems, and fire separations,
    2. required exhaust fume barriers and self-closing devices on doors between an attached or built-in garage and a dwelling unit,
    3. water supply, sewage disposal, lighting and heating systems,
    4. protection of foamed plastics,
    5. water systems,
    6. building drains and building sewers,
    7. drainage systems and venting systems, and
    8. radon control requirements

This section applies to:

    1. A residential building, other than a retirement home, that,
      • exceeds 600 m2 in building area or exceeds 3 storeys in building height,
      • is built of combustible construction,
      • is sprinklered throughout,
      • is not more than 6 storeys in building height,
      • has a height not more than 18 m measured between the floor of the first storey and the uppermost floor level that does not serve a rooftop enclosure for elevator machinery, a stairway or a service room used only for service to the building, and
      • has a building area not more than
        • 9,000 m2 if 1 storey in building height,
        • 4,500 m2 if 2 storeys in building height,
        • 3,000 m2 if 3 storeys in building height,
        • 2,250 mif 4 storeys in building height,
        • 1,800 mif 5 storeys in building height, or
        • 1,500 mif 6 storeys in building height, and
        • Is designed in conformance with Div. B, Article 3.2.2.51. of the OBC
    2. A building used for business and personal services occupancy that,
      • exceeds 600 m2 in building area or exceeds 3 storeys in building height,
      • is built of combustible construction,
      • is sprinklered throughout,
      • is not more than 4 storeys in building height, and
      • has a building area not more than 3 600 m2, and
      • is designed in conformance with Div. B, Article 3.2.2.61. of the OBC

Occupancy Requirements

An occupancy permit shall be issued provided that there are not any outstanding orders and the following building components and systems are complete, operational and inspected:

    1. the structure of the building is completed to the roof,
    2. the building envelope, including, but not limited to, cladding, roofing, windows, doors, assemblies requiring fire-resistance ratings, closures, insulation, vapour barriers and air barriers, is complete,
    3. the walls enclosing the space to be occupied are completed, including balcony guards,
    4. all required fire separations and closures are completed,
    5. all required exits are completed, including all fire separations, doors, door hardware, self-closing devices, guards and handrails,
    6. all shafts including closures are completed,
    7. measures have been taken to prevent access to parts of the building and site that are incomplete or still under construction,
    8. floors, halls, lobbies and required means of egress are free of loose materials and other hazards,
    9. if service rooms should be in operation, required fire separations and closures are completed,
    10. all building drains, building sewers, water systems, drainage systems and venting systems are complete and tested as operational for the storeys to be occupied,
    11. required lighting, heating and electrical supply are provided for the suites, rooms and common areas to be occupied,
    12. required lighting in corridors, stairways and exits is completed and operational,
    13. required standpipe, sprinkler and fire alarm systems are complete and operational, together with required pumper connections for such standpipes and sprinklers,
    14. required smoke alarms and carbon monoxide alarms are complete and operational,
    15. required fire extinguishers have been installed,
    16. main garbage rooms, chutes and ancillary services are completed to all storeys to be occupied,
    17. required firefighting access routes have been provided and are accessible, and
    18. the sewage system has been completed and is operational.

This section applies to any building that does not meet the descriptions provided above.

Occupancy Requirements

An occupancy permit shall be issued provided that there are not any outstanding orders and the following building components and systems are complete, operational and inspected:

    1. the structure of the building or part of it is completed to the roof,
    2. the enclosing walls of the building or part of them are completed to the roof,
    3. the walls enclosing the space to be occupied are completed, including balcony guards,
    4. all required fire separations and closures are completed on all storeys to be occupied,
    5. all required exits are completed, including all fire separations, doors, door hardware, self-closing devices, guards and handrails, from the uppermost floor to be occupied down to grade level and below if an exit connects with lower storeys,
    6. all shafts including closures are completed to the floor-ceiling assembly above the storey to be occupied and have a temporary fire separation at such assembly,
    7. measures have been taken to prevent access to parts of the building and site that are incomplete or still under construction,
    8. floors, halls, lobbies and required means of egress are free of loose materials and other hazards,
    9. if service rooms should be in operation, required fire separations and closures are completed,
    10. all building drains, building sewers, water systems, drainage systems and venting systems are complete and tested as operational for the storeys to be occupied,
    11. required lighting, heating and electrical supply are provided for the suites, rooms and common areas to be occupied,
    12. required lighting in corridors, stairways and exits is completed and operational up to and including all storeys to be occupied,
    13. required standpipe, sprinkler and fire alarm systems are complete and operational up to and including all storeys to be occupied, together with required pumper connections for such standpipes and sprinklers,
    14. required fire extinguishers have been installed on all storeys to be occupied,
    15. main garbage rooms, chutes and ancillary services are completed to all storeys to be occupied,
    16. required firefighting access routes have been provided and are accessible, and
    17. the sewage system has been completed and is operational.

The Chief Building Official, Inspector, or Director of Fire & Protective Services may require the installation of a fence where they believe the construction site may pose a hazard to public safety.

Examples of locations where a fence may be required include

    • Next to sidewalks or roadways
    • Next to occupied buildings
    • Areas close to schools, parks, recreational or other public facilities

Where required, such fences shall

    • be erected so as to fully enclose all areas of the site which present a hazard;
    • create a continuous barrier and be sufficient to deter unauthorized entry;
    • have a height not less than 1.2 meters above grade at any point, unless the Chief Building Official or Inspector determines that a greater minimum height is necessary;
    • if constructed of plastic mesh, snow fencing, or other similar materials, be securely fastened at 200mm on centre to vertical posts not more than 1.2 metres apart, and horizontal members or a minimum 11-gauge cable at the top and bottom; and
    • be maintained in a vertical plane and in good repair.
